(The Hill) – Công tố viên liên bang vào thứ 5 đồng ư nhấc bỏ lệnh “khoá miệng – gag order” đối với Michael Cohen, cho phép cựu luật sư tư của Tổng thống Donald Trump tiếp tục viết hồi kư trong thời gian thụ bản án 3 năm tù tại gia.

Văn pḥng Biện lư Hoa Kỳ tại Manhattan rút lại quan điểm Cohen không nên được trao đổi với truyền thông hay xuất bản bất cứ thông tin ǵ trong thời gian bị giam giữ tại nhà, sau khi thẩm phán liên bang mới đây phán quyết, điều kiện này nhằm trả đũa việc ông ta đang dự tính viết sách về những năm tháng làm việc cho ông Trump.


Trong hồ sơ đệ lên toà vào chiều thứ 5, phía công tố cho hay, “các bên đồng ư rằng một điều khoản cụ thể liên quan đến Nguyên đơn liên lạc với truyền thông không cần thiết.”

Cựu luật sư tư của Tổng thống nhận tội những cáo buộc gian lận và khai man trước Quốc hội vào năm 2018. Cohen bắt đầu lên tiếng chống lại Trump trong thời gian đối mặt với những thách thức pháp lư.

Cohen ban đầu được thả ra khỏi tù liên bang ở New York về giam giữ tại nhà vào tháng 5 do đại dịch virus corona, nhưng vào đầu tháng 7 bất ngờ bị đưa trở lại nhà tù sau khi ông và luật sư phản đối lệnh “bịt miệng” không cho công khai bàn luận những thông tin liên quan nằm trong các điều khoản được giam giữ tại gia. Liên đoàn Tự do Dân sự Mỹ khởi kiện Bộ Tư pháp với lập luận điều khoản vi phạm quyền Tu chính án Thứ nhất.

Thẩm phán toà liên bang Alvin Hellerstein đồng ư, và trong phiên điều trần hồi đầu tháng, toà chỉ trích Bộ Tư pháp và ra án lệnh cho Cohen quay trở lại giam giữ tại gia.

“Tôi chưa bao giờ từng thấy một điều khoản như vậy trong 21 năm làm thẩm phán và tuyên án người ta, nh́n vào những điều khoản quản chế, tôi chưa từng thấy điều kiện như vậy,” thẩm phán Hellerstein nói. “Tại sao Cơ quan Cải huấn lại yêu cầu điều như vậy … trừ phi có mục đích trả đũa?”

Cohen sẽ được nói chuyện thoải mái với truyền thông nếu thẩm phán Hellerstein phê chuẩn những điều kiện được văn pḥng Biện lư Hoa Kỳ đệ lên vào thứ 5.
