Dân biểu Mo Brooks (Cộng Ḥa-AL) đang bị Dân biểu Eric Swalwell (Dân Chủ-CA) kiện v́ vai tṛ của Brooks đă tiếp tay kích động cuộc bạo loạn ngày 6/1/2021.


DB Brooks vào ngày 6/1/2021 đă đọc diễn văn tại cuộc biểu t́nh MAGA của Trump và nói với ước tính 12.000 người tham dự, "Hôm nay là ngày những người yêu nước Mỹ bắt đầu tống cổ và đá đít [bọn Dân Chủ ở Quốc Hội]." Chính DB Brooks khi ra biểu t́nh đă mặc áo giáp chống đạn v́ dự kiến sẽ có bạo lực.

Chính Brooks cũng là thành viên Quốc hội đầu tiên tuyên bố sẽ bỏ phiếu để lật ngược cuộc bầu cử để trao Bạch Ốc cho Trump. Và vào tháng 12, Politico đưa tin Brooks đang "dẫn đầu nỗ lực dài hơi để lật ngược kết quả bầu cử tại Quốc hội", đồng thời lưu ư rằng ông đă tổ chức "ba cuộc họp ở Bạch Ốc, kéo dài hơn ba giờ và bao gồm khoảng một chục nhà lập pháp."

Theo phóng viên chuyên về các vấn đề pháp lư Jan Wolfe của Reuters, hồ sơ tự biện hộ của DB Mo Brooks viết các chủ điểm như sau, để xin thẩm phán xóa bỏ đơn kiện của DB Swalwell:

"Brooks chưa bao giờ đụng xe mà trong đó bất kỳ ai khẳng định Brooks là người có lỗi."
"Brooks đă kết hôn được 45 năm. Brooks luôn chung thủy với vợ. Họ đă cùng nhau nuôi nấng 4 đứa con, tất cả đều đă kết hôn, chưa ai ly hôn, không đứa nào bị bắt v́ lỗi ǵ, tất cả đều tốt nghiệp đại học và có việc làm."
