Trước đó, ban tranh cử của ông Trump đă yêu cầu Tối Cao Pháp Viện ra lệnh cho Ngoại Trưởng Pennsylvania Kathy Boockvar phải trả lời về đơn kiện vào trước thứ Tư, 23 tháng 12, và cũng yêu cầu ṭa án phán quyết về vụ kiện trước ngày 6 tháng 1.

các thẩm phán trong tuần này đă ra hạn chót để Ngoại Trưởng Boockvar trả lời cho vụ kiện là đến ngày 22 tháng 1. Điều này có nghĩa là, vào thời điểm vụ kiện có thể có thêm bất kỳ tiến triển ǵ mới, Tổng Thống đắc cử Joe Biden đă hoàn thành việc tuyên thệ nhậm chức.

Ban tranh cử của ông Trump khởi kiện sau khi Thẩm Phán Samuel Alito của Tối Cao Pháp Viện tỏ ra nghi ngờ về tính hợp hiến của cuộc bầu cử tại Pennsylvania, khi tiểu bang để nhánh tư pháp thay đổi các đạo luật quản lư cuộc bầu cử tổng thống.
Nếu Tối Cao Pháp Viện phán quyết có lợi cho ban tranh cử của Tổng Thống Trump, Pennsylvania có thể phải xác nhận lại kết quả bầu cử và tiểu bang phải chứng minh rằng họ có đủ số phiếu hợp lệ để giữ nguyên kết quả này.
