(Bloomberg) — Toà Phúc thẩm liên bang giữ nguyên phán quyết của toà cấp dưới, nghiêm cấm chính phủ xây tường biên giới phía Nam bằng những ngân khoảng không được Quốc hội phê chuẩn.

Án lệnh được hội đồng 3 thẩm phán toà kháng án tại San Francisco đưa ra vào hôm thứ Tư liên quan đến thỉnh nguyện từ chính phủ, yêu cầu cho toà cho phép bắt đầu thủ tục dùng $1 tỉ Mỹ kim ngân sách Bộ Quốc pḥng để xây tường biên giới ở tiểu bang Arizona và New Mexico trong khi các cuộc chiến pháp lư vẫn đang tiếp tục.

Trong thời gian vận động tranh cử vào năm 2016, ông Trump hứa hẹn sẽ xây tường biên giới, và với những ǵ đang diễn ra, Tổng thống Mỹ dự tính sẽ yêu cầu Tối cao Pháp viện can thiệp.

Ông Trump ban đầu cần $5,6 tỉ Mỹ kim để xây tường nhưng Dân chủ trong Quốc hội từ chối, hai bên dằng co khiến chính phủ đóng cửa 35 ngày. Sau khi Quốc hội phê chuẩn $1,38 tỉ cho an ninh biên giới, Trump lấy lư do làn sóng di dân đổ về biên giới tăng cao, tuyên bố t́nh trạng khẩn cấp quốc gia vào ngày 15 tháng 2 để có thể lấy tiền xây tường từ những nguồn ngân khoản khác.

Một thẩm phán ở Oakland, California, vào tháng 5 quyết định tạm thời ngăn chặn hai dự án xây tường ở New Mexico (46 dặm) và Arizona (5 dặm). Vào ngày 28 tháng 6, thẩm phán toà liên bang Haywood Gilliam mở rộng lệnh cấm thêm 4 dự án khác, tuyên bố phán quyết có hiệu lực vĩnh viễn.

Trong phán quyết vào hôm thứ Tư, hai thẩm phán kết luận hành động của Tổng thống vi phạm quyền hạn hiến pháp của Quốc hội trong việc sử dụng tiền thuế của dân. Hai thẩm phán cũng cho rằng, giữ nguyên quyết định ngưng xây tường của ông Gilliam không thay đổi t́nh trạng tại biên giới phía Nam, nơi các nguồn lực đang căng thẳng v́ t́nh trạng di dân Trung Mỹ t́m cách vào Mỹ gia tăng.

Thẩm phán thứ 3 trong hội đồng phúc thẩm, ông N. Randy Smith có quan điểm khác. “Phần lớn ở đây đang có bước đi chưa từng có và rủi ro, biến mọi câu hỏi về liệu một nhân viên hành pháp có vượt quá quyền hạn theo luật quy định thành vấn đề hiến pháp,” thẩm phán ghi quyết định chống.

Hay đào cái lổ phía dưới rồi chun qua, lổ nhỏ th́ chun qua từng người một, lồ lớn th́ hàng đôi, hàng 3, hàng 4 đi qua thoải mái như diển binh ngày July 4th.

Có thể Xi Chum sẻ xây cái hàng rào này cho Mar Lago resort ở Florida cho mặt bằng của hắn?

Bảo đảm trong ṿng vài ngày th́ ma túy sẽ tràn lan nhanh hơn là đi tàu hoặc đi xe vận tải, như vụ bắt hơn 16 tấn ở hải cảng Philadelphia hôm nọ.... GREEN POWER !
